Terms & Conditions

These Terms of Use (“Terms”) are entered into by and between you (“you” or “User”) and Spiece Fieldhouse Catering LLC, an Indiana limited liability company, doing business as Power Courts (“Power Courts,” “Company,” “we,” “us,” or “our”). These Terms govern your access to and use of https://www.powercourtspickleball.com/ (the “Website”), including any content, functionality, and services offered through the Website, including online reservations, memberships, programs, and related services (collectively, the “Services”).

By accessing or using the Website or Services, you agree to be bound by these Terms. If you do not agree, do not use the Website or Services.

1) Eligibility; Minors

The Website and Services are intended for users who can form a legally binding contract. If you are under 18, you may use the Website or Services only with the involvement and consent of your parent or legal guardian, who must accept these Terms and any required waivers on your behalf and remain responsible for your conduct and obligations.

We may require proof of age or guardianship at any time.

2) Changes to These Terms

We may revise these Terms at any time in our sole discretion by posting an updated version on the Website. Changes are effective immediately upon posting and apply to all use after posting. Your continued use constitutes acceptance.

3) Access; Account Security

We may withdraw, modify, suspend, or discontinue the Website or any Services at any time, without notice.

You are responsible for maintaining the confidentiality of your account credentials and for all activity under your account. You agree to notify us immediately of any unauthorized access or security breach.

We may suspend or terminate your account or access to the Website/Services at any time, for any reason, including suspected fraud, safety concerns, nonpayment, chargebacks, or violation of these Terms, facility rules, or policies.

4) Reservations, Memberships, and Facility Rules

Power Courts operates Power Courts Pickleball Club (the “Facility”) located at 5310 Merchandise Dr, Ft Wayne, IN 46825. When you reserve courts, attend events, or use the Facility, you agree to:

  • Comply with all applicable laws and all posted Facility rules, policies, and staff instructions;

  • Use the Facility in a safe, respectful manner;

  • Supervise your guests and any minors in your party as required by law and our policies;

  • Not engage in conduct we determine is unsafe, disruptive, or inappropriate.

We may refuse service or remove any person from the Facility in our sole discretion.

5) Guests

You are responsible for the conduct of any guests you bring to the Facility or include in a reservation. You agree that all guests must comply with these Terms, Facility rules, and all posted policies, and you remain liable for your guests’ actions, damages, and charges.

6) Prohibited Uses (Website + Facility)

You may not use the Website or Services:

  • For any unlawful purpose;

  • To interfere with, damage, overload, or disrupt the Website, Services, or Facility operations;

  • To attempt unauthorized access to systems or data;

  • To scrape, crawl, harvest data, or use automated tools without our prior written consent;

  • To impersonate others or submit false information;

  • To post or transmit harmful, abusive, obscene, threatening, harassing, defamatory, or infringing content.

At the Facility, prohibited conduct includes (without limitation): unsafe play, harassment, violence, vandalism, theft, disorderly conduct, illegal drug activity, or other behavior that we believe may endanger people or property or harm our business or reputation.

Alcohol: If alcohol is served or permitted, you agree to comply with all laws and our policies. We may refuse alcohol service to anyone at any time and may remove anyone we believe is impaired or unsafe.

7) Payments; Refunds; Administrative Fees

Fees for reservations, memberships, events, and other Services are displayed at the time of purchase and may be changed by us at any time.

​

Refundability: Some purchases may be refundable and others may be nonrefundable, as stated at checkout and/or in our posted cancellation/refund policies. You agree those policies are incorporated into these Terms by reference.

Nonpayment/Chargebacks: If a payment is declined, reversed, disputed, charged back, or otherwise not paid, we may suspend your account and deny access to the Facility and Services until all amounts are paid. You remain responsible for all amounts due.

Administrative Fee: If we incur costs related to your violation of these Terms or policies (including excessive cleaning, damages, chargebacks, disputes, or collections), we may charge you an administrative fee up to $150 per incident, plus any actual costs permitted by law.

​

8) Damage, Repairs, and Cleaning

You are responsible for leaving the Facility in the condition it was in when you arrived, reasonable wear and tear excepted. You are responsible for the cost of repair, replacement, and/or cleaning required due to damage or excessive mess caused by you or your guests.

9) Required Waiver; Assumption of Risk

Use of the Facility and participation in pickleball, events, and related activities involve inherent risks, including serious injury, property damage, and illness.

Waiver Required: You acknowledge and agree that execution of our digital waiver and release of liability (the “Waiver”) is required for you and your guests (and for minors, by a parent/legal guardian) as a condition of access to the Facility and Services. The Waiver is incorporated into these Terms by reference. If you do not sign (or ensure signing), you and/or your guests may be denied entry or removed without refund.

10) Video Surveillance; Content Sharing; Publicity Release

For safety, security, operational, and marketing purposes, the Facility may use video surveillance and other recording technologies. The Facility may also offer content sharing (including replay or recorded clips) and may record gameplay and activities in and around the Facility.

By entering and using the Facility and/or Services, you consent to being recorded and to our use of such recordings for lawful purposes, including operations, training, incident review, marketing, and social media. You grant us a worldwide, royalty-free license to use your name, image, likeness, and voice captured in such recordings for these purposes, subject to applicable law.

​

You represent that you have obtained all necessary permissions for any guests or minors you bring. If you do not want to appear in marketing content, you may contact us at info@powercourtspickleball.com; we will consider reasonable requests but cannot guarantee removal from all uses, especially where recordings are incidental or required for safety/security.

​

11) Third-Party Services (PlayByPoint; Payment Processor)

We use third-party vendors to provide certain Services, including PlayByPoint for reservations/memberships and a third-party payment processor (the “Payment Processor”). Your use of those services may be subject to their separate terms and privacy policies. We are not responsible for third-party systems, outages, errors, or acts/omissions.

12) Intellectual Property; Limited License

The Website and its contents (text, images, logos, designs, software, and other materials) are owned by us or our licensors and protected by intellectual property laws. We grant you a limited, revocable, non-transferable license to use the Website for personal, non-commercial purposes.

​

You may not copy, reproduce, distribute, modify, create derivative works, publicly display, or exploit any Website content without our prior written consent.

​

13) User Content

If the Website allows you to post content (reviews, comments, uploads, etc.), you retain ownership of your content but grant us a non-exclusive, worldwide, royalty-free license to use, host, reproduce, modify, display, and distribute that content as necessary to operate and promote the Services.

​

You represent you have all rights needed to post such content and that it does not violate laws or third-party rights.

14) Disclaimers

THE WEBSITE AND SERVICES ARE PROVIDED ON AN “AS IS” AND “AS AVAILABLE” BASIS. TO THE FULLEST EXTENT PERMITTED BY LAW, WE DISCLAIM ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

We do not guarantee uninterrupted or error-free operation of the Website or that the Website will be free of viruses or harmful components.

​

15) Limitation of Liability

TO THE FULLEST EXTENT PERMITTED BY LAW, IN NO EVENT SHALL THE COMPANY OR ITS AFFILIATES, OWNERS, OFFICERS, DIRECTORS, EMPLOYEES, AGENTS, OR SERVICE PROVIDERS BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR FOR LOST PROFITS, LOST REVENUE, LOSS OF DATA, OR BUSINESS INTERRUPTION, ARISING OUT OF OR RELATED TO YOUR USE OF THE WEBSITE, SERVICES, OR FACILITY, EVEN IF ADVISED OF THE POSSIBILITY.

OUR TOTAL LIABILITY FOR ANY CLAIM SHALL NOT EXCEED THE GREATER OF (A) THE AMOUNT YOU PAID US IN THE THREE (3) MONTHS PRIOR TO THE EVENT GIVING RISE TO THE CLAIM OR (B) $100, EXCEPT WHERE PROHIBITED BY LAW.

16) Indemnification

You agree to defend, indemnify, and hold harmless the Company and its affiliates and personnel from and against any claims, liabilities, damages, losses, and expenses (including attorneys’ fees) arising out of or related to: (a) your use of the Website, Services, or Facility; (b) your violation of these Terms or any policy; (c) your guests’ or minors’ conduct; or (d) your User Content.

17) Dispute Resolution; Governing Law; Venue; Class Action Waiver

Governing Law: These Terms and any dispute arising out of or relating to them are governed by the laws of the State of Indiana, without regard to conflict-of-law rules.

​

Venue: Unless required otherwise by applicable law, you agree that any lawsuit or proceeding shall be brought exclusively in the state or federal courts located in Allen County, Indiana, and you consent to personal jurisdiction and venue there.

Class Action Waiver: To the fullest extent permitted by law, you agree that disputes will be brought only on an individual basis and not as a plaintiff or class member in any purported class, collective, or representative action.

18) Time Limit to Bring Claims

To the fullest extent permitted by law, any claim or cause of action arising out of or related to the Website, Services, Facility, or these Terms must be brought within one (1) year after the claim arises, or it is permanently barred.

19) Termination

We may suspend or terminate your access to the Website, Services, Facility, or your account at any time, with or without notice, for any reason, including violations of these Terms, policies, safety concerns, suspected fraud, or nonpayment. Termination does not limit any rights or remedies we may have.

20) Miscellaneous

Severability: If any provision is held invalid or unenforceable, the remaining provisions remain in full force.

No Waiver: Our failure to enforce any provision is not a waiver.

Entire Agreement: These Terms (and the Waiver and any posted policies incorporated by reference) constitute the entire agreement between you and the Company regarding the Website and Services.
